This Privacy Policy describes how Brightstar treats Your use of the Sites, including the collection, storage, transfer, sharing, disclosure and handling of Your personal information and Your use of Our products and Services which We define further in this Privacy Policy.

This Privacy Policy does not apply to (i) any of Our Products and/or Services that do not display or link to this Privacy Policy, or (ii) that have their own individual Privacy Policy, or (iii) to information We collect from You or about You in other ways, including through e-mails that You may choose to send Us. As indicated above, this Privacy Policy does not apply to Your use of Our mobile applications or the services associated with those mobile applications (the Privacy Policy for our Mobile Applications and Services is accessible through Your mobile application).

By using Brightstar’s Products and/or Services, You acknowledge that You have read this Privacy Policy and consent to Brightstar’s privacy practices as described in this Privacy Policy, including Our use and disclosure of Your personal information for the purposes described in this Privacy Policy. 2. Description of Our Products and Services

Brightstar offers comprehensive mobile device protection programs through its various Sites. Brightstar provides its customers with the ability to file warranty claims, insurance claims, and service requests through its Sites. These offerings are defined under this Privacy Policy collectively and individually as Our "Products" and "Services."

3. Types of Information Collected and How It Is Collected

The types of information We may collect from You when You access Our Sites or use Our Products and/or Services are listed below. Brightstar may share Your information with its affiliates, subsidiaries, partners, and other third parties, such as third parties who help operate the Sites and its related databases. Brightstar requires such organizations to comply with the requirements set out in this Privacy Policy. We collect information directly from You, through Your use of Our Sites, Products, and/or Services or from third parties that work with Brightstar to deliver Our Products and/or Services.

3.1 Personal Information We Request From You.

Certain areas of the Sites (filing claims and/or services requests, registering products, etc.) will require You to provide personal information to Brightstar. Personal information may include Your name, phone number, e-mail address, username, password, claim/service request ID, date of log-in, and details provided by You explaining circumstances under which You are requesting assistance or information from Brightstar, or similar information. As part of the claim and/or service request process, Brightstar or its affiliates may require You to provide a copy of Your driver’s license, passport, military ID, or other personal identification card. Additionally, in order to process Your claim and/or service request, and complete Your transaction, Brightstar or its affiliates may request Your shipping and billing information, credit card information or other preferred payment means. While it is solely Your choice whether to provide the requested information, We cannot provide certain services You request if You do not provide the requested non-optional personal information. By submitting personal information to Brightstar, You agree that Brightstar may use the information in accordance with this Privacy Policy. For example, Brightstar may use the information to register and service Your claim or service request, process Your requests, adapt and improve Brightstar services to better suit Your needs, provide benefits You are entitled to, and to meet regulatory or contractual requirements relating to the Services provided to You. If You do submit such personal information to Brightstar, Brightstar may share that information with third parties, in addition to using that information for the purposes for which it was submitted by You.

Brightstar may also use this personal information in other ways, such as to provide You with information about Products, Services, and offers that may be of interest to You, to seek follow-up from You about Your experiences with Brightstar, or as otherwise disclosed to You at the point of collection. Where required, Brightstar will seek Your express consent to send such messages, including when sent by e-mail or other type of commercial electronic message. This consent is sought by Brightstar Device Protection, LLC, Brightstar Protection Ltd., Brightstar Insurance Services, B.V. and other members of the Brightstar corporate family. You may withdraw Your consent by using the "unsubscribe" link located at the bottom of such messages You receive from Brightstar, or by contacting Brightstar at the phone number in Your applicable Terms of Service.

Brightstar may share Your personal information with its affiliates, subsidiaries, partners, and with other third parties for similar purposes. Additionally, to the extent required by applicable law, Brightstar will provide Your personal information to others without seeking Your consent. By submitting personal information to Brightstar, You give Brightstar permission to receive, review, edit, store, and use Your personal information for the purposes described in this Privacy Policy.

Your personal information may be sent to Brightstar entities and third party service providers located in the United States and may be seen by foreign governments or their agencies.

3.2 Other Types of Information We Collect

Brightstar may also collect certain information about the use of Brightstar’s Sites, including the number of unique visitors, the frequency of visits, how users interact with the Sites, user experience preferences, IP addresses, and other information that may help Brightstar improve the customer experience, mitigate fraudulent activity, and comply with legal requirements. Such information may include, but is not limited to the following:

3.2.1 Log Information. When You visit Brightstar’s Sites We automatically collect and store certain information in Our server logs. This type of information includes details on how You interacted with Our Sites, Services, or applications. Such information may include, but is not limited to: IP address, Unique Device Identifier, or Caller ID / ANI (Automatic Number Identification) information, content of web pages, transaction with APIs (Application Program Interface), transactions with IVR (Interactive Voice Response) systems, activity and content of visitor interaction with call center representatives; application usage activity, hardware information, hardware and system settings, browser type, browser language, the date and time of Your request, and referral URL.

3.2.2 Cookies. The Sites use "cookies" to help personalize Your online experience. A cookie is a text file that is placed on Your hard disk by a Web page server. Cookies cannot be used to run programs or deliver viruses to Your computer. Cookies are uniquely assigned to You, and can only be read by a web server in the domain that issued the cookie.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize Brightstar pages, or register with Brightstar Sites or Services, cookies help Brightstar recall Your specific information on subsequent visits. This simplifies the process of recording Your personal information, such as billing addresses and shipping addresses.

You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but You can usually modify Your browser setting to decline cookies. If You choose to decline cookies, You may not be able to fully experience the interactive features of the Brightstar Services or Sites.

3.2.3 Pixel TagsCertain pages on Our Sites may contain pixel tags, also known as a clear GIF or a web beacon. A pixel tag is an invisible tag placed on certain pages of Our Sites but not on Your device. When You access these pages, pixel tags generate a generic notice of that visit. They usually work in conjunction with cookies and allow third parties to obtain information such as when a particular computer visits a particular page, the URL of the page on which the tag appears, or time of access and browser type. If You turn off cookies the pixel tag will simply detect an anonymous website visit.

3.2.4 IP Addresses. IP addresses are an additional way for Brightstar and third parties to analyze the traffic of the Sites by keeping track of the visitors to the Sites. An IP address is a unique identifier assigned to each computer browser accessing the internet. We may view the IP address of the device You use to access the Internet. Third parties may use this information to determine the general physical location of the device and understand from what geographical regions users are from.

3.2.5 Third Party Data SourcesBrightstar may leverage external data sources in order to provide context and background on the users of its Sites, Services, or applications in order to improve customer experience, mitigate fraud or malicious activity, or to comply with internal company and external regulatory requirements.

3.2.6 Do Not Track Do-Not-Track is a public-private initiative that has developed a technical "flag" or signal that an end-user may be able to activate within their browser software to notify websites that they do not wish to be "tracked" by third parties as defined by the initiative. However, the initiative has not reached a consensus as to exactly what technical or other actions those parties receiving the signal should take. As a result, Do-Not-Track has not been standardized and most websites, including Brightstar Sites, do not alter their behavior or change their services when they receive a do-not-track signal or flag.

4. Retention and Deletion of Personal Information

Brightstar will retain Your personal information for as long as necessary for Brightstar to fulfill the purpose(s) for which the information was collected and to comply with applicable laws. Your consent to such purpose(s) remains valid with respect to claims and/or service request data and to file claims and/or service requests related to coverage after termination of Brightstar’s agreement with You.

5. Use of your Personal Information

Brightstar collects and uses Your personal information to operate the Sites and deliver the Products and Services You request. We may contact You via surveys to conduct research about Your opinion of current services or of potential new services that may be offered. In addition to any of the previously mentioned uses of personal information in this Privacy Policy, Brightstar may use Your personal information collected on the Sites for other purposes including to:

(ii) Activate and maintaining Your account;

(iii) Billing and resolving billing disputes to the extent Your telecommunications carrier does not provide such services;

(iv) Contact You to offer Product or Service updates and notices, promotional notices, and other information about Products and Services or other services available from Brightstar or its affiliates;

(v) Provide you with Products or Services or carrying out the transaction(s) You have requested or authorized;

(vi) Respond to Your questions, inquiries, comments, and instructions;

(vii) Improve the Sites by solving technical problems, calculate overall usage statistics, internal marketing and promotional purposes, product development, and content improvement;

(viii) Take good faith measures to enforce terms and conditions; and

(ix) Maintain the security and integrity of the Sites and Brightstar’s systems.

6. Sharing and Disclosing Personal Information

Brightstar may share or disclosure Your personal information in the following instances:

(i) Help establish and verify Your identify;

(ii) Activate and maintaining Your account;

(iii) Billing and resolving billing disputes to the extent Your telecommunications carrier does not provide such services;

(iv) Contact You to offer Product or Service updates and notices, promotional notices, and other information about Products and Services or other services available from Brightstar or its affiliates;

(v) Provide you with Products or Services or carrying out the transaction(s) You have requested or authorized;

(vi) Respond to Your questions, inquiries, comments, and instructions;

(vii) Improve the Sites by solving technical problems, calculate overall usage statistics, internal marketing and promotional purposes, product development, and content improvement;

(viii) Take good faith measures to enforce terms and conditions; and

(ix) Maintain the security and integrity of the Sites and Brightstar’s systems

6. Sharing and Disclosing Personal Information

Brightstar may share or disclosure Your personal information in the following instances:

(i) To fulfill a service to You.

(ii) To assist our affiliates, strategic partners, agents, or from third party marketers and other unaffiliated parties for research, administrative, and/or other business purpose.

((iii) To unaffiliated third party service providers, agents, or independent contractors who help maintain Brightstar services and provide other administrative services such as:

a. Order processing and fulfillment;

a. Order processing and fulfillment;

b. Providing customer service;

c. Maintaining and analyzing data;

d. Sending customer notifications on Brightstar’s behalf; and

e. Entry collection, winner selection, and prize fulfillment contests, sweepstakes, and other promotions

(iv) To complete Your purchase(s) or other transaction(s).

(v) To comply with law, or in the good faith belief that such action is necessary to conform to the requirements of law, or comply with a legal process served on Brightstar, and to protect and defend Brightstar’s rights, property, or services, or act in urgent circumstances to protect Your personal safety or that of others.

(vi) To third parties as part of a corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of Brightstar’s assets.>

(vii) To track and analyze non-identifying, aggregate usage and volume statistical information from visitors and customers and provide such information to third parties.

(viii) To protect against fraud and potential fraud.

a. Brightstar may verify the information You provide to obtain Our Products and Services through third parties who are contractually prohibited from using any information We provide them for any purpose not specified by Brightstar. In the course of such verification, Brightstar may receive additional personal information about You from such services. In particular, if You use a credit or debit card to purchase Services with Us, We may use such card authorization and fraud screenings to verify that Your card information and address match the information You supplied to Us, and that the card has not been reported as lost or stolen.

(ix) To notify You of any known breaches of personal information.

Brightstar does not sell, rent or lease its customer lists to third parties. Brightstar may, from time to time, contact You on behalf of external business partners about a particular offering that may be of interest to You. In those cases, Your personal information is not transferred to the third party. In addition, Brightstar may share information with third parties to perform statistical analysis, send You email or postal mail, provide customer support, or arrange for deliveries. All third parties involved with such activities are prohibited from using Your personal information except to provide these services and they are required to maintain the confidentiality of Your information. Brightstar keeps track of the Web sites and pages our customers visit within Brightstar. This data may be used to deliver customized content and advertising within Brightstar to customers whose behavior may indicate they are interested in a particular subject area.

7. Legal Disclosure

Brightstar may disclose Your personal information and Your use of the Sites, without notice, if We believe that such disclosure is necessary to:

(i) Comply with the law or comply with legal process (e.g. request from an administrative oversight agency, civil suit, subpoena, court order or judicial or administrative proceeding) served on Brightstar or the Site;

(ii) Protect and defend the rights or property of Brightstar or the rights and property of others;

(iii) Enforce Our Terms of Service and/or this Privacy Policy; and

(iv) Respond to claims that the content(s) of a communication violates the rights of another.

8. Security of Information

Brightstar secures Your personal information on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information is transmitted to other Web sites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol. While Brightstar adheres to generally accepted industry standards to protect Your personal information from unauthorized access, use or disclosure, no transmission of information over the internet is fully secure. While We strive to protect Your personal information, We cannot guarantee its absolute security. Please consider this prior to submitting any information to Brightstar through the Sites.

9. Accuracy and Completeness of Your Information

Brightstar takes various steps to reasonably ensure the accuracy and completeness of personal information. However, Brightstar relies on Our client partners to provide accurate and complete enrollment data about You that they directly collect from You and provide to Brightstar. Brightstar also relies on You to provide accurate and complete information when submitting a claim/service request or interact with Brightstar for any other purpose.

10. Credit Card Processing and Data Security

Brightstar does not receive funds directly from You. Brightstar utilizes a third party billing and payment processing gateway that provides the infrastructure and security necessary to provide secure transmission of Your credit card transaction data. Brightstar can only accept credit cards for processing through Our secured payment processing gateway. Although Brightstar does not control the security environment for them and cannot make any guarantees regarding the secure processing of Your credit card transaction data, We want to inform You that Our credit card processor is compliant with the Payment Card Industry Data Security Standard ("PCI DSS") as a Level 1 service provider. Brightstar demands that Our credit card processors are complaint with PCI DSS. PCI DSS is the bankcard industry’s most stringent security standard. Examples of Our credit card processor’s security measures include: physical, electronic, and procedural safeguards; sophisticated security monitoring tools; documented security policies; use of strong encryption for transmissions of order information to and from Our customers; restricting access to personal information; and periodic security audits by third party security experts.

11. Access to Your Information and Your Ability to Correct or Delete Your Information

Upon request via postal mail or e-mail, Brightstar will provide You with a summary of Your personal information that is retained by Brightstar. As allowed by law and consistent with Our applicable agreements, You may modify, correct, change, or request Brightstar to delete or update any personal information that Brightstar has collected through the Sites by Contacting Brightstar via postal mail or e-mail as provided in the Contact and Electronic Communication section of this Privacy Policy. Brightstar may retain an archived copy of Your records as required by law or for legitimate business purposes.

12. Children under 13

The Services provided by Brightstar, including but not limited to the Sites, are not intended for anyone under the age of 13. Brightstar does not knowingly collect personal information from anyone under the age of 13. For more information about protecting your child’s privacy online, visit the United States of America Federal Trade Commission website. Brightstar will take steps to remove personal information and terminate the account should Brightstar determine that a child under 13 has accessed the Services.

13. Third Party Sites

The Sites may contain links to other websites, including websites operated by non-affiliated or independent third parties. Please be aware that those sites may collect personal information from or about You and Your visit. Those sites have not necessarily been reviewed by Brightstar and are maintained by third parties over which Brightstar exercises no control. Brightstar expressly disclaims any and all responsibility for the privacy policies, information collection practices, content, accuracy of the information, and/or the quality of products or services provided by or advertised on those third-party websites. Links contained on the Sites do not imply an endorsement with respect to any third party or any website or the products or services provided by any third party. You should review the privacy policies that are posted on any website You visit before using the website and providing personal information to the website. Brightstar is not responsible for the privacy policies or practices of any websites that may be mentioned on, or accessible from, the Sites.

14. Changes to this Privacy Policy

Brightstar reserves the right to revise or update this Privacy Policy at any time, and You agree to be bound by those revisions or updates. Brightstar will notify You of any changes to the Privacy Policy by posting the revised or updated Privacy Policy and its Effective Date on the Sites. Your use of the Sites, Products, and/or Services thereafter constitutes Your agreement to and acceptance of the Privacy Policy and its revisions or updates. You should periodically read the Privacy Policy to learn of any revisions or updates. In the event We materially change the way in which We use Your personal information, We will provide You with notice and ask You to affirmatively accept the changes to a new Privacy Policy. This Privacy Policy is incorporated as part of the Terms of Service that apply with respect to Your use of the Sites and Our Products and Services, as defined in this Privacy Policy. 15. Social Media

Any information, communication, or material of any type that You submit to the Sites or through Brightstar Services (including, but not limited to any Brightstar Site contained on a social media platform or website such as Facebook, Instagram, or Twitter) by e-mail, posting, messaging, uploading, downloading, or otherwise (collectively, a "Submission") is done at Your own risk and without any expectation of privacy. Brightstar cannot control the actions of other users of any social media platform or website and Brightstar is not responsible for any content of Submissions contained on such websites or platforms. By visiting any Brightstar Sites that are contained on a social media platform or website, You are representing and warranting to Brightstar that You have reviewed the applicable Privacy Policy and Terms of Use of such platform or website and that You will abide by all such provisions contained therein. Further, in the event that Brightstar offers a message board or any other interactive or social-type feature on the Sites, please be aware that these areas may allow You to publicly post and share with other users certain messages, content, and other information (e.g. stories, pictures, tips, etc.). Although Brightstar may take certain precautions to protect those who use these areas of the Sites, Brightstar encourages You to be wary of providing any of Your personal information in such public forums. The information You submit can be collected and used by people You do not know. Brightstar does not guarantee the privacy and safety of these areas and is not responsible or liable for any information You choose to submit. Your use of these features is fully at Your own risk.

16. International Users

The Sites are operated, in whole or in part, from the United States. Brightstar may transfer information that We collect about You, including Your personal information, to subsidiary and affiliated entities, or to other third parties across borders and from Your country or jurisdiction to other countries or jurisdictions around the world. If You are visiting from the European Union, Canada, or other regions with laws governing data collection and use that may differ from United States laws, You acknowledge that You are transferring information about Yourself, including personal information, to a country and jurisdiction that does not have the same data protection laws as the European Union, Canada or other region, and You consent to have Your personal information transferred to and processed in the United States for the purposes identified in this Privacy Policy and the use and collect of Your personal information in accordance with this Privacy Policy.
